SolPods Privacy Policy for Offline, Online and Electronic Use

1.  Introduction

We care deeply about the privacy of our visitors and users, and we are committed to safeguarding the privacy of your information. This Privacy Policy ("Privacy Policy") informs you of SolPods ("SolPods", "we", "our", or "us") policies regarding the collection, use and disclosure of Personal Information and/or Personal Data (collectively, "Personal Information") when you use this website or other digital and online services and the choices you have associated with that Personal Information. Personal Information means data that can be used to identify an individual. This Privacy Policy applies to all SolPods users, including unregistered visitors and registered users (collectively, “Users”, “you”, or “your”), and to all SolPods services, including our Website ("www.solpods.org", the "Website" or "Site") web applications (“SolPods Apps”), mobile applications (“Mobile Apps”), and related services including browsing and accessing content (“Content”), including but not limited to our podcasts, emails and newsletters, posts and blogs, registering for our workshops, trainings and educational materials (“Programs”) or becoming a member of the SolPods community (“Community”), collectively, the Services ("Services").
 

This Privacy Policy only applies to the information collected by SolPods and any third parties acting with our authorization or information otherwise provided to us by third parties about you, in each instance, in connection with your use of the Services. This Privacy Policy applies regardless of the computer, mobile phone, tablet or other electronic device you use to access the Services.

Prior to accessing or using our Services, please read this Privacy Policy and make sure you fully understand our practices in relation to your Personal Information. If you do not agree with this Policy or the SolPods Terms & Conditions do not use any part of this Site. By using the Services, you agree that your use of the Services is governed by this Privacy Policy, and this constitutes a positive action confirming your consent for us to use the personal data you provide to us in accordance with this Policy.  

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. Your continued use of the Services affirms your agreement to any changes we make to this Privacy Policy.

2.  What Personal Information do we collect?

We collect two types of information from you: (1) Personal Information voluntarily provided by you and (2) non-identifying data about your use of our Site (“General Information”).

We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; and computer and connection information. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications) and comments, feedback, recommendations and personal profile.

2.1 Personal Information

We collect Personal Information when you voluntarily provide it to us through the Service by, for example, signing up for our email distribution list, contacting us regarding a career opportunity or joining our Community.

 

Personal Information may include, but is not limited to

  • email address;

  • first name and last name;

  • phone number;

  • address, State, Province, ZIP/Postal code, City, Country;

  • profile picture, other pictures, images, and videos from your device's camera and/or stored on your device;

  • feedback, updates, comments and other information submitted via our Service;

  • electronic forms, surveys or other interactive portions of our Service;

  • sustainability preferences and interests; and

  • education and career aspirations. 

It is your choice to provide your Personal Information. You do not need to disclose more Personal Information than is requested. You should not provide Personal Information about others unless you are expressly authorized to do so.  You may opt out of receiving any, or all, communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us at hello@solpods.org.

We obtain other Personal Information from the software company, Mighty Networks, which hosts the SolPods Community.  For example, when using the SolPods Community, you have the option of registering using an Integrated Service, such as Facebook. If you choose to do this, your profile picture and other Personal Information in your profile on the Integrated Service will become part of your profile on Mighty Networks. 2.2 General Information

We also automatically collect General Information about how you navigate our Site using tracking technologies, including, but not limited to, small text files called “cookies” and electronic images known as “web beacons.”  Cookies are files with a small amount of data which may include an anonymous unique identifier to track activity. Cookies are sent to your browser from a website and stored on your device. We have enabled site-visitors the opportunity to accept or decline non-essential cookies on our Site. If you refuse or delete cookies, some of our site functionality may be impaired.  If you change computers, devices, or browsers, or use multiple computers, devices, or browsers, and delete your cookies, you may need to repeat this process for each computer, device, or browser.  Please refer to your browser’s ‘Help’ instructions to learn more about how to manage cookies and the use of other tracking technologies.

General Information may include, without limitation, your:

  • Internet Protocol (IP) address;

  • Internet Service Provider (ISP);

As outlined above the SolPods Community is hosted by Mighty Networks.  Mighty Networks uses cookies to collect information about user visits to their website and use of Services. 3. How do we use your Personal Information?

We will use your Personal Information for the purposes for which it was collected and for the limited purposes set forth below: 

  • to share our newsletters, community challenges, member surveys, career information and good news updates;

  • to respond to your inquiries;

  • to provide technical support;

  • to communicate with you about our partnerships for education;

  • to share marketing or promotional materials and other information that may be of interest to you; and

  • to communicate with you about our Services, initiatives or other efforts to pursue SolPods' mission to protect the planet.

We will not share your Personal Information with any third parties, unless it is necessary:

  • To support SolPods’ mission. Specifically, we may share your information with our employees and certain third parties, such as contractors and service providers, that need access to such information to carry out work on our behalf, including to:

    • respond to your requests;

    • process payments for our Services;

    • send newsletters, community challenges, member surveys, career information, good news updates, notices or content; and

    • administer, enhance and troubleshoot the Site;

  • To change website hosts; and

  • To comply with the law and regulations, court orders, subpoenas or other legal demands.

4. How do we use your General Information?

We will aggregate and analyze General Information and/or inferred non-Personal Information and use it for operational and administrative purposes, including to identify our Site visitors’ levels and areas of interest in our content and to maintain and improve the Site and our Services. 

5.  How do we share your information?

We may share your Personal Information and any storage information with any other firms, insofar as reasonably necessary for providing a service, at our sole discretion, including but not limited to Wix, our web hosting platform, and its vendors, and Mighty Networks, our Community hosting platform, and its vendors, collectively known as our Vendors ("Vendors"); the privacy policies and disclaimers of each of these companies, as written on each firm’s website, are hereby adopted by SolPods if fully set forth herein.  We do not rent or sell your Personal Information to third parties.

We may also share this information when we believe disclosure is appropriate to comply with applicable law or a court order, subpoena, warrant, or other legal process; when we believe disclosure is appropriate to enforce our Terms of Use and other agreements and policies, to protect against fraud or other unlawful activity, or to protect our rights and the rights of third parties; or if we are involved in a merger, acquisition, bankruptcy, partial or total sale of assets, or other corporate change.


We may share information that has been de-identified or aggregated, or any other technical information, without limitation.

6.  Where do we store your Personal Information?

Personal Information that is collected by our website host, Wix, may be stored in data centers located in the United States of America, Ireland and Israel. Wix may use other jurisdictions as necessary for the proper delivery of their Services and/or as may be required by law.  Wix.com Ltd. is based in Israel, which is considered by the European Commission to be offering an adequate level of protection for the Personal Information of EU Member State residents. Wix affiliates and Third-Party Service Providers that store or process your Personal Information on Wix’s behalf are contractually committed to keep it protected and secured, in accordance with industry standards and regardless of any lesser legal requirements which may apply in their jurisdiction.  For more information please see the Wix Privacy Policy.

7.  Links to other Sites

Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services. 

8. Your rights in relation to your Personal Information

SolPods believes that it is imperative that all of our users have control over their Personal Information. You may object to, or restrict, our collection, use, sharing, transfer and/or storage of your personal information. You may also request a copy of the information that we have about you. 10.  Residents of the European Economic Area, the United Kingdom and Switzerland and Privacy Rights 

Your rights under the European Union’s General Data Protection Regulation (“GDPR”): Users who are located in the European Economic Area (“EEA”), U.K. or Switzerland have the right to lodge a complaint about our data collection and processing actions with the supervisory authority concerned. If you are located in the EEA, U.K. or Switzerland, you have the following rights:

  • Access and Portability: Request access to personal data we hold about you or request transmission of your data to a third party.

  • Correction: Request that we rectify inaccurate or incomplete personal data we store about you.

  • Erasure: Request that we erase personal data when such data is no longer necessary for the purpose for which it was collected, when you withdraw consent and no other legal basis for processing exists, or when you believe that your fundamental rights to data privacy and protection outweigh our legitimate interest in continuing the processing.

We will no longer process the data unless there are compelling legitimate grounds for our processing that override your interests, rights, and freedoms, or for the purpose of asserting, exercising, or defending legal claims.

11.  Children

This Site complies with the Children’s Online Privacy Protection Act of 1998.  Our Services are not intended for the use of children, and we do not knowingly collect information online from persons under the legal age of 13. If we are informed that we have unintentionally received personal information from a child under the age of 13, we will delete that information.  If you become aware of any Personal Information we have collected from a child without parental consent, please email us at hello@solpods.earth.  Our databases may nevertheless contain personal data of children due to the fact that it is not always possible to determine precisely the age of the user. 12. Security

While no data transmission over the Internet is one hundred percent secure from intrusion, we maintain reasonable physical, electronic, and procedural safeguards to protect our Site. However, it is possible that third parties may unlawfully intercept or access transmissions or private communications despite our efforts to prevent this. We do not represent or guarantee the security of Personal Information or other information in any form. Similarly, we disclaim liability for Personal Information submitted through our Site and you provide us with this data at your own risk. 

13.  Changes to This Privacy Policy

We may update our Privacy Policy at any time. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page. If you disagree with any of the terms herein, please immediately discontinue use of the Service.
